Access to Justice: A Lifeline for Domestic Abuse Victims 

Access to justice is a cornerstone of a fair society but, for many victims of domestic abuse, it remains an uphill battle. Rising legal costs, overstretched services and complex court procedures often create barriers that leave survivors vulnerable and unsupported. At Domestic Abuse (DA) Alliance, we believe justice should never be a privilege. 

Our evidence to the Justice Committee’s Inquiry into Access to Justicepublished herehighlights the urgent need for reform and innovation. 

Why Access to Justice Matters 

For victims of domestic abuse, legal protection can mean the difference between safety and continued harm. Yet, many face delays, confusion and even the loss of the opportunity protective measures because they cannot access timely legal advice or representation. Acting without legal support often leads to procedural errors, failed hearings, and retraumatisationpushing victims to disengage from the process entirely. 

Our Solutions: Technology Meets Advocacy 

We’re harnessing innovation to break down these barriers: 

WEPROTECT App

WEPROTECT is a rapid referral service that connects frontline responderssuch as police officers and domestic abuse support workerswith civil legal professionals. Victims gain immediate access to legal support and assistance to apply for protective court orders, including Non-Molestation orders, Occupation Orders and Domestic Abuse Protection Orders, reducing delays and confusion. 

WeProcess is a next-generation platform for legal document services. With real-time updates, AI-driven checks and secure communication portals, WeProcess helps law firms move cases forward quickly and cost-effectively, cutting delays and reducing costs for clients. 

The Power of Digital Innovation

They also offer resilience against system failures, ensuring continuity even during crises like the recent Legal Aid Agency cyber-attack. Funding Justice Without Burdening the Public Purse 

Improving access to justice doesn’t have to rely solely on government funding. We advocate for innovative models such as: 

  • Access to Justice Fund Levy on high-earning legal firms. 
  • Third-Party Litigation Funding and Conditional Fee Arrangements for civil claims. 
  • Corporate Social Responsibility Partnerships, like emergency funds for survivors. 

These approaches reduce upfront costs for victims while ensuring service providers are compensated fairly. 

Our Priorities for Change 

  1. Legal Aid Reform: Remove means testing for domestic abuse victims and ensure fair remuneration for providers. 
  1. Community-Based Services: Increase funding for specialist support services that are often the first point of contact for victims. 
  1. Training for Professionals: Mandatory domestic abuse training for police and legal practitioners.
